اطلاعیه شماره ۶۹ قوه قضاییه درباره جنگ تحمیلی سوم/ستاد حقوق بشر: تحریم‌های هوانوردی آمریکا علیه ایران جان و سلامت مردم را به خطر می‌اندازد

ستاد حقوق بشر با انتشار بیانیه‌ای با اشاره به تحریم‌های هوانوردی آمریکا علیه ایران، اعلام کرد: هوانوردی غیرنظامی صرفا یک فعالیّت اقتصادی و تجاری نیست، بلکه حوزه‌ای است که به‌صورت مستقیم با ایمنی، سلامت و جان انسان‌ها ارتباط دارد.

ستاد حقوق بشر جمهوری اسلامی ایران با انتشار بیانیه‌ای ضمن محکومیت تحریم‌های هوانوردی ایران، اعلام کرد: محدودسازی دسترسی ایران به خدمات، تجهیزات، قطعات و ظرفیت‌های فنی مورد نیاز هوانوردی غیرنظامی، اقدامی نگران‌کننده از منظر حقوق بشر، حقوق بین‌الملل و اصول حاکم بر نظام بین‌المللی هواپیمایی کشوری است.

متن این بیانیه به شرح زیر است:

ستاد حقوق بشر جمهوری اسلامی ایران، اقدام اخیر دولت ایالات متحده آمریکا در تشدید و گسترش تحریم‌ها علیه صنعت هوانوردی جمهوری اسلامی ایران و اعمال فشار بر شرکت‌ها و اشخاص ثالث با هدف محدودسازی دسترسی ایران به خدمات، تجهیزات، قطعات و ظرفیت‌های فنی مورد نیاز هوانوردی غیرنظامی را قویا محکوم می‌کند و آن را اقدامی نگران‌کننده از منظر حقوق بشر، حقوق بین‌الملل و اصول حاکم بر نظام بین‌المللی هواپیمایی کشوری می‌داند.

وزارت خزانه‌داری ایالات متحده آمریکا در ۸ سپتامبر ۲۰۲۶ اعلام کرد که مجموعه­‌ای از اشخاص، شرکت­‌ها و شبکه‌­های مرتبط با بخش هوانوردی جمهوری اسلامی ایران را در چارچوب اقدامات تحریمی خود هدف قرار داده است؛ دامنه این اقدام، بنا بر اعلام طرف آمریکایی، اشخاص و واسطه‌های خارجی و شبکه‌های مرتبط با تامین هواپیما و فناوری و خدمات مورد نیاز صنعت هوانوردی ایران را نیز دربر می‌گیرد.

ستاد حقوق بشر جمهوری اسلامی ایران تاکید می‌کند که هوانوردی غیرنظامی صرفا یک فعالیت اقتصادی و تجاری نیست، بلکه حوزه‌ای است که مستقیما با ایمنی، سلامت و جان انسان‌ها ارتباط دارد؛ استمرار ایمنی پرواز‌ها مستلزم دسترسی منظم و پایدار به قطعات یدکی، موتور، تجهیزات ناوبری و ارتباطی، خدمات تعمیر و نگهداری، پشتیبانی فنی و سایر ملزومات تخصصی است و ایجاد محدودیت در این زنجیره می‌تواند پیامد‌هایی فراتر از روابط تجاری و اقتصادی داشته باشد.

نظام حقوقی بین‌المللی حاکم بر هوانوردی کشوری نیز بر ضرورت توسعه ایمن و منظم هواپیمایی بین‌المللی و همکاری میان دولت‌ها استوار است؛ کنوانسیون شیکاگو ۱۹۴۴، که جمهوری اسلامی ایران از اعضای آن است، در ماده ۴۴ ازجمله توسعه ایمن و منظم هواپیمایی کشوری بین‌المللی، تامین نیاز‌های مردم جهان به حمل‌ونقل هوایی ایمن، منظم، کارآمد و اقتصادی و جلوگیری از تبعیض میان دولت‌های متعاهد را از اهداف سازمان بین‌المللی هواپیمایی کشوری برشمرده است؛ از این منظر، اقداماتی که آثار عملی آن‌ها به محدودسازی دسترسی یک دولت عضو به تجهیزات، قطعات و خدمات ضروری برای حفظ ایمنی هوانوردی منجر شود، شایسته بررسی در پرتو اهداف و تعهدات ناشی از نظام حقوقی بین‌المللی هوانوردی کشوری است.

موضوع آثار تحریم‌ها بر ایمنی هوانوردی ایران نیز مسبوق به سابقه است؛ در سند رسمی A۳۶-WP/۲۷۵ که در چارچوب سازمان بین‌المللی هواپیمایی کشوری ارائه شد، آثار تحریم‌های آمریکا بر هوانوردی غیرنظامی ایران و پیامد‌های محدودیت در دسترسی به قطعات و خدمات ضروری ایمنی مورد بررسی قرار گرفته و در این سند، به گزارش ماموریت ایکائو در ایران در سال ۲۰۰۵ و ارزیابی آثار تحریم‌های اقتصادی بر ایمنی هوانوردی اشاره شده است؛ این سابقه نشان می‌دهد که پیوند میان محدودیت‌های تحریمی و ایمنی هوانوردی، موضوعی است که پیش‌تر نیز در ساختار تخصصی سازمان ملل متحد مورد توجّه قرار گرفته است.

در همین چارچوب، باید به دستور اقدام موقت دیوان بین‌المللی دادگستری در تاریخ ۳ اکتبر ۲۰۱۸ در قضیه «نقض‌های ادعایی عهدنامه مودت، روابط اقتصادی و حقوق کنسولی ۱۹۵۵ (جمهوری اسلامی ایران علیه ایالات متحده آمریکا)» اشاره کرد؛ دیوان در آن قرار، از ایالات متحده خواست تا موانع ناشی از اقدامات اعلام‌شده در ۸ مه ۲۰۱۸ را در مسیر صادرات آزاد به ایران در سه حوزه برطرف کند: (۱) دارو و تجهیزات پزشکی؛ (۲) مواد غذایی و محصولات کشاورزی؛ و (۳) قطعات یدکی، تجهیزات و خدمات مرتبط (شامل گارانتی، تعمیر و نگهداری و بازرسی‌های مرتبط با ایمنی) که برای ایمنی هواپیمایی کشوری ضروری هستند؛ دیوان تصریح کرد که این تحریم‌ها «پتانسیل به خطر انداختن ایمنی هواپیمایی کشوری در ایران و جان استفاده‌کنندگان از آن را دارد»؛ این قرار موقت که براساس ماده ۴۱ دیوان صادر شده و مطابق با رویه دیوان واجد اثر الزام‌­آور است، نشان‌دهنده پذیرش اولیه این استدلال است که محدودیت‌های تحریمی در حوزه هوانوردی غیرنظامی، به دلیل پیوند مستقیم با ایمنی و جان انسان‌ها، موضوعی قابل بررسی در چارچوب تعهدات بین‌المللی است.

از منظر حقوق بشر نیز نمی‌توان نسبت به پیامد‌های چنین اقداماتی بی‌تفاوت بود؛ حق حیات، مطابق ماده ۶ میثاق بین‌المللی حقوق مدنی و سیاسی، از حقوق بنیادین انسان است و حق برخورداری از بالاترین استاندارد قابل حصول سلامت جسمی و روانی نیز در ماده ۱۲ میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی به رسمیت شناخته شده است؛ هنگامی که محدودیت‌های اقتصادی و تحریمی به حوزه‌هایی تسری پیدا می‌کند که با ایمنی حمل‌ونقل و حفظ جان و سلامت انسان‌ها ارتباط مستقیم دارد، ارزیابی آثار انسانی این اقدامات به یک ضرورت حقوق بشری تبدیل می‌شود.

در همین راستا، خانم النا دوهان، گزارشگر ویژه شورای حقوق بشر سازمان ملل متحد در خصوص آثار منفی اقدامات قهری یک‌جانبه بر بهره‌مندی از حقوق بشر، در گزارش خود درباره تاثیر این اقدامات بر حق سلامت، نسبت به پیامد‌های محدودیت‌های یک‌جانبه بر دسترسی به کالا‌ها و خدمات ضروری و بهره‌مندی مؤثر از حقوق بشر ابراز نگرانی کرده است؛ همچنین سازوکار‌های حقوق بشری سازمان ملل متحد پیش‌تر در ارتباط با آثار تحریم‌های آمریکا علیه ایران، نگرانی‌هایی درباره تاثیر این اقدامات بر حق سلامت و حق حیات مطرح کرده‌اند.

بدیهی است که اعمال صلاحیت داخلی دولت‌ها در حوزه سیاست خارجی و اقتصادی، در چارچوب نظام حقوق بین‌الملل موضوعی پیچیده و تابع شرایط و تعهدات خاص هر دولت است؛ با این حال، هنگامی که آثار یک تصمیم داخلی از مرز‌های کشور تحریم‌کننده فراتر رفته و شرکت‌ها و اشخاص کشور‌های ثالث را نیز در معرض فشار و محدودیت قرار می‌دهد و هم‌زمان به حوزه‌ای مرتبط با ایمنی پرواز و حقوق بنیادین انسان‌ها تسری می‌یابد، ضرورت بررسی آن در چارچوب قواعد و تعهدات بین‌المللی بیش از پیش آشکار می‌شود.

ستاد حقوق بشر جمهوری اسلامی ایران بر این باور است که اختلافات و ملاحظات سیاسی میان دولت‌ها نباید به بهای تضعیف استاندارد‌های ایمنی هوانوردی، محدودسازی دسترسی مردم به حمل‌ونقل هوایی ایمن و یا افزایش مخاطراتی تمام شود که مستقیما متوجه جان و سلامت انسان‌هاست؛ هوانوردی غیرنظامی و ایمنی پرواز‌ها نباید به ابزار اعمال فشار سیاسی تبدیل شود و اصل انسانی بودن حقوق بین‌الملل اقتضا می‌کند که پیامد‌های انسانی اقدامات اقتصادی و تحریمی مورد توجه جدی قرار گیرد.

از جامعه بین‌المللی، به‌ویژه سازمان ملل متحد، شورای حقوق بشر، سازمان بین‌المللی هواپیمایی کشوری و سازوکار‌های ذی‌ربط حقوق بشری انتظار می‌رود در قبال آثار انسانی تحریم‌های هوانوردی رویکردی مسئولانه و مبتنی بر اصول حقوق بین‌الملل اتخاذ کنند و اجازه ندهند ملاحظات سیاسی بر الزامات مربوط به ایمنی هوانوردی و حمایت از حقوق بنیادین انسان‌ها غلبه کند.

ستاد حقوق بشر جمهوری اسلامی ایران همچنین از سازمان بین‌المللی هواپیمایی کشوری می‌خواهد با توجه به سابقه بررسی موضوع تحریم‌های هوانوردی ایران در این سازمان، آثار اقدامات جدید بر ایمنی هوانوردی غیرنظامی ایران را مورد توجه قرار داده و در چارچوب صلاحیت‌ها و مسئولیت‌های خود نسبت به تضمین رعایت اصول حاکم بر ایمنی، همکاری و عدم تبعیض در هوانوردی بین‌المللی اقدام مقتضی به عمل آورد.

جمهوری اسلامی ایران ضمن محکومیت تحریم‌های اعمال‌شده علیه صنعت هوانوردی غیرنظامی کشور، تاکید می‌کند که حقوق بنیادین مردم نباید تحت تاثیر سیاست‌های فشار اقتصادی و اقدامات قهری یک‌جانبه قرار گیرد؛ حفظ جان و سلامت انسان‌ها، رعایت اصول ایمنی و احترام به تعهدات بین‌المللی، مسئولیتی مشترک برای جامعه جهانی است و هیچ ملاحظه سیاسی نباید این مسئولیت را تحت‌الشعاع قرار دهد.

ستاد حقوق بشر جمهوری اسلامی ایران بر تداوم پیگیری موضوع از مجاری حقوقی و بین‌المللی تاکید کرده و از تمامی سازوکار‌های ذی‌ربط بین‌المللی می‌خواهد با رویکردی مستقل، بی‌طرفانه و مبتنی بر موازین حقوق بشر و حقوق بین‌الملل، آثار اقدامات قهری یک‌جانبه بر ایمنی هوانوردی و حقوق مردم ایران را مورد بررسی قرار دهند.

Statement by the High Council for Human Rights of the Islamic Republic of Iran Condemning Sanctions on the Islamic Republic of Iran’s Aviation System
 
The High Council for Human Rights of the Islamic Republic of Iran strongly condemns the recent action by the Government of the United States of America to intensify and expand sanctions against the Islamic Republic of Iran’s aviation industry, as well as to exert pressure on third-country companies and individuals with the aim of restricting Iran’s access to the services, equipment, spare parts, and technical capabilities required for civil aviation. It considers such measures to be a matter of serious concern from the perspectives of human rights, international law, and the principles governing the international civil aviation system.
On 8 September 2026, the United States Department of the Treasury announced that it had targeted a number of individuals, companies, and networks associated with the aviation sector of the Islamic Republic of Iran as part of its sanctions measures. According to the U.S. side, the scope of this action also encompasses foreign individuals and intermediaries, as well as networks associated with the procurement of aircraft and the provision of technology and services required by Iran’s aviation industry.

The High Council for Human Rights of the Islamic Republic of Iran emphasizes that civil aviation is not merely an economic or commercial activity; rather, it is a sector directly connected with the safety, health, and lives of human beings. The continued safety of flight operations requires regular and reliable access to spare parts, engines, navigation and communication equipment, maintenance and repair services, technical support, and other specialized necessities. Imposing restrictions on this supply and support chain may therefore have consequences extending beyond commercial and economic relations.

The international legal framework governing civil aviation is likewise founded upon the need for the safe and orderly development of international air transport and cooperation among States. The 1944 Chicago Convention, to which the Islamic Republic of Iran is a party, provides in Article 44, inter alia, that the objectives of the International Civil Aviation Organization include fostering the safe and orderly development of international civil aviation, meeting the needs of the peoples of the world for safe, regular, efficient, and economical air transport, and preventing discrimination between Contracting States. From this perspective, measures whose practical effects result in restricting a Member State’s access to equipment, spare parts, and services essential to maintaining aviation safety warrant consideration in light of the objectives and obligations arising from the international legal framework governing civil aviation.

The issue of the impact of sanctions on aviation safety in Iran is not without precedent. In the official document A36-WP/275, submitted within the framework of the International Civil Aviation Organization (ICAO), the effects of U.S. sanctions on Iran’s civil aviation sector and the consequences of restrictions on access to essential safety-related parts and services were examined. The document also refers to the ICAO mission to Iran in 2005 and to its assessment of the impact of economic sanctions on aviation safety. This precedent demonstrates that the link between sanctions-related restrictions and aviation safety is an issue that has previously received attention within the specialized institutional framework of the United Nations.

Within this framework, reference should also be made to the Order on Provisional Measures issued by the International Court of Justice (ICJ) on 3 October 2018 in the case concerning Alleged Violations of the 1955 Treaty of Amity, Economic Relations, and Consular Rights (Islamic Republic of Iran v. United States of America). In that Order, the Court called upon the United States to remove obstacles arising from the measures announced on 8 May 2018 to the free exportation to Iran of goods and services in three areas: (۱) medicines and medical devices; (۲) foodstuffs and agricultural products; and (۳) spare parts, equipment, and associated services—including warranty, maintenance, and inspection services—necessary for the safety of civil aviation. The Court expressly stated that such sanctions had the “potential to endanger the safety of civil aviation in Iran and the lives of its users.” This provisional-measures Order, issued pursuant to Article 41 of the Statute of the Court and, in accordance with the Court’s jurisprudence, having binding effect, reflects the Court’s preliminary recognition that sanctions-related restrictions affecting civil aviation, given their direct connection with safety and human life, constitute a matter capable of being examined within the framework of international obligations.

From a human rights perspective, the potential consequences of such measures cannot be disregarded. The right to life, as recognized in Article 6 of the International Covenant on Civil and Political Rights, is a fundamental human right, while the right to the enjoyment of the highest attainable standard of physical and mental health is recognized in Article 12 of the International Covenant on Economic, Social and Cultural Rights. Where economic and sanctions-related restrictions extend to areas directly connected with the safety of transportation and the protection of human life and health, assessing the human rights impact of such measures becomes a matter of necessity from a human rights perspective.

In this regard, Ms. Alena Douhan, the United Nations Special Rapporteur on the Negative Impact of the Unilateral Coercive Measures on the Enjoyment of Human Rights, in her report on the impact of such measures on the right to health, has expressed concern about the consequences of unilateral restrictions on access to essential goods and services and on the effective enjoyment of human rights. The human rights mechanisms of the United Nations have also previously raised concerns, in connection with the effects of U.S. sanctions against Iran, regarding the impact of such measures on the right to health and the right to life.
It is self-evident that the exercise of States’ domestic jurisdiction in the areas of foreign and economic policy is, within the framework of international law, a complex matter subject to the specific circumstances and obligations of each State. Nevertheless, when the effects of a domestic decision extend beyond the territory of the sanctioning State, exposing companies and individuals in third countries to pressure and restrictions, while at the same time extending to an area directly connected with flight safety and fundamental human rights, the need to examine such measures within the framework of international rules and obligations becomes all the more evident.

The High Council for Human Rights of the Islamic Republic of Iran maintains that political differences and considerations among States should not come at the expense of weakening aviation safety standards, restricting people’s access to safe air transportation, or increasing risks that directly threaten human life and health. Civil aviation and flight safety should not be used as instruments of political pressure, and the humanitarian character of international law requires that the human consequences of economic and sanctions-related measures be given serious consideration.

The international community, particularly the United Nations, the Human Rights Council, the International Civil Aviation Organization, and the relevant human rights mechanisms, are expected to adopt a responsible approach, grounded in the principles of international law, with regard to the human consequences of aviation-related sanctions, and to ensure that political considerations do not prevail over the requirements of aviation safety and the protection of fundamental human rights.

The High Council for Human Rights of the Islamic Republic of Iran also calls upon the International Civil Aviation Organization, taking into account the Organization’s previous consideration of the issue of aviation sanctions against Iran, to take due account of the effects of the new measures on the safety of Iran’s civil aviation and, within the scope of its authorities and responsibilities, to take appropriate measures to ensure compliance with the principles governing safety, cooperation, and non-discrimination in international civil aviation.

The Islamic Republic of Iran, while condemning the sanctions imposed against the country’s civil aviation industry, emphasizes that the fundamental rights of the people should not be adversely affected by policies of economic pressure and unilateral coercive measures. The protection of human life and health, adherence to safety principles, and respect for international obligations constitute a shared responsibility of the international community, and no political consideration should be allowed to undermine this responsibility.

The High Council for Human Rights of the Islamic Republic of Iran reaffirms its commitment to pursuing this matter through legal and international channels and calls upon all relevant international mechanisms to examine, through an independent, impartial, and human rights- and international law-based approach, the effects of unilateral coercive measures on aviation safety and the rights of the Iranian people.
